The Potatoes Originating in Egypt (Amendment) Regulations (Northern Ireland) 2000

The Department of Agriculture and Rural Development, being a Department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by the said section 2(2) and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Potatoes Originating in Egypt (Amendment) Regulations (Northern Ireland) 2000 and shall come into operation on 26th April 2000.

(2) The Interpretation Act (Northern Ireland) 1954(3) shall apply to those Regulations as it applies to an Act of the Northern Ireland Assembly.

Amendment of the Potatoes Originating in Egypt Regulations (Northern Ireland) 1998

2.—(1) The Potatoes Originating in Egypt Regulations (Northern Ireland) 1998(4) shall be amended in accordance with paragraphs (2) and (3).

(2) In regulation 2(1) (interpretation) for the definition of “the Decision” there shall be substituted—

“the Decision” means Commission Decision 96/301/EC authorising member States temporarily to take additional measures against the dissemination of Pseudomonas solanacearum (Smith) Smith as regards Egypt(5) as amended by Commission Decision 98/105/EC authorising member States temporarily to take emergency measures against the dissemination of Pseudomonas solanacearum (Smith) Smith as regards Egypt(6), Commission Decision 98/503/EC authorising member States temporarily to take emergency measures against the dissemination of Pseudomonas solanacearum (Smith) Smith as regards Egypt(7), and Commission Decision 99/842/EC authorising member States temporarily to take emergency measures against the dissemination of Pseudomonas solanacearum as regards Egypt(8);.

(3) In regulation 5A—

(a)for the heading “Fees in respect of the sampling of seed potatoes landed in Northern Ireland” there shall be substituted “Fees in respect of the sampling of potatoes landed in Northern Ireland”;

(b)in paragraph (1), the word “seed” after “consignment of” shall be omitted.

(4) In regulation 3(2) (landing of potatoes originating in Egypt) and regulation 5A(1) (Fees in respect of the sampling of potatoes landed in Northern Ireland), for the words “Pseudomonas solanacearum (Smith) Smith”, there shall be substituted “Ralstonia solanacearum (Smith) Yabuuchi et al.”(9).

Explanatory Note

(This note is not part of the Regulations.)

These Regulations implement Commission Decision 99/842/EC amending Decision 96/301/EC and authorising member States temporarily to take emergency measures against the dissemination of Pseudomonas solanacearum (Smith) Smith as regards Egypt (O.J. No. L.326, 18.12.98, p. 68) by amending the definition of “the Decision” in the Potatoes Originating in Egypt Regulations (Northern Ireland) 1998 (“the 1998 Regulations”) (regulation 2(2)). Decision 99/842/EC makes minor modifications to the requirements applying to potatoes imported into member States from Egypt.

These Regulations also replace the references to “Pseudomonas solanacearum (Smith) Smith” in the 1998 Regulations with references to “Ralstonia solanacearum (Smith) Yabuuchi et al.” (regulation 2(5)).

These Regulations also replace references to “seed potatoes” in regulation 5A of the 1998 Regulations with references to “potatoes” (regulation 2(3)): this is a small correction.
