Local Government (Defined Activities) (Exemptions) Order (Northern Ireland) 1999

Title, commencement and interpretation

1.—(1) This Order may be cited as the Local Government (Defined Activities) (Exemptions) Order (Northern Ireland) 1999 and shall come into operation on 1st October 1999.

(2) In this Order “the exemption end date for a council” shall be construed in accordance with Article 3.

Activities not to be treated as defined activities

2.  Where an activity specified in columns 2 to 7 of the Schedule is carried out by a council specified in column 1 of the Schedule on or before the exemption end date for that council, that activity shall not be treated as a defined activity on or before the exemption end date for that council.

Provision as to end of exemption

3.  In respect of each council specified in column 1 of the Schedule, the exemption end date for that council is—

(a) in respect of collection of refuse, the date specified opposite that council in column 2 of that Schedule;

(b) in respect of other cleaning, the date specified opposite that council in column 3 of that Schedule;

(c) in respect of maintenance of ground, the date specified opposite that council in column 4 of that Schedule;

(d) in respect of repair and maintenance of vehicles, the date specified opposite that council in column 5 of that Schedule;

(e) in respect of managing sport and leisure facilities, the date specified opposite that council in column 6 of that Schedule;

(f) in respect of construction and maintenance work, the date specified opposite that council in column 7 of that Schedule.
