Health and Safety (Modifications) Regulations (Northern Ireland) 1999

Coming into operation

1st April 1999

The Department of Economic Development, being a Department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2), in exercise of the powers conferred on it by the said section 2(2) and of every other power enabling it in that behalf and, being the Department concerned(3), in exercise of the powers conferred on it by Articles 2(5), 4(4) and (6), 16(3) and (4), 17, 40(2) to (4) and (6), 43(2) and (3), 54(1) to (4) and 55(2) of, and Schedule 3 to, the Health and Safety at Work (Northern Ireland) Order 1978 (“the 1978 Order”)(4), by Articles 3(2) and (3) and 4(2) and (3) of the Offshore, and Pipelines, Safety (Northern Ireland) Order 1992(5) and of every other power enabling it in that behalf, and also in exercise of the powers conferred on it by Articles 49 and 55(2) of the 1978 Order and of every other power enabling it in that behalf, after consultation in accordance with Articles 46(1) and 54(5) of the 1978 Order with the Health and Safety Agency for Northern Ireland and such other bodies as appeared to the Department to be appropriate, hereby makes the following Regulations:—

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Health and Safety (Modifications) Regulations (Northern Ireland) 1999 and shall come into operation on 1st April 1999.

(2) The Interpretation Act (Northern Ireland) 1954(6) shall apply to these Regulations as it applies to a Measure of the Northern Ireland Assembly.

Modification of statutory provisions

2.  The statutory provisions specified in column 1 of the Schedule shall have effect subject to the modifications specified opposite thereto in column 3 of the Schedule.

Transitional provision

3.  Any exemption, approval, authorisation, certificate, notice or direction granted or given or other thing whatsoever done, or having effect as if granted, given or done, for the purpose of any provision modified by these Regulations, shall, if in force immediately before the coming into operation of these Regulations, continue in force and have effect as if granted, given or done in accordance with that provision as so modified.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend various statutory provisions to take account of the amendments to the Health and Safety at Work (Northern Ireland) Order 1978, S.I. 1978/1039 (N.I. 9) (“the 1978 Order”) made by the Health and Safety at Work (Amendment) (Northern Ireland) Order 1998, S.I. 1998/2795 (N.I. 18). The latter Order renames the Health and Safety Agency for Northern Ireland as the Health and Safety Executive for Northern Ireland and provides for the Executive to enforce the provisions of the 1978 Order and to provide the employment medical advisory service.
