1. These Regulations may be cited as the Education (Certified Contracts) Regulations (Northern Ireland) 1999 and shall come into operation on 15th February 1999.
2. A board shall ensure that a copy of every certificate issued by it is given to each of the persons with whom the board has entered, or is to enter, into the contract in relation to which the certificate is issued, and to the Comptroller and Auditor General for Northern Ireland.
3.—(1) Where, in relation to any contract, a board–
(a)States in a certificate that it had or has power to enter into the contract; and
(b)Specifies that the statutory provision, or one of the statutory provisions, conferring power on it to do so in paragraph 13 of Schedule 2 to the Education Libraries (Northern Ireland) Order 1986(1), or Article 106 of that Order,
the board shall also specify the principal statutory provision which conferred upon it the functions for the purposes of which it entered into the contract.
(2) For the purposes of this regulation, in relation to a contract, a function is a relevant function if the contract is calculated to facilitate, or is conducive or incidental to, the discharge of the function.
4. A board which is under the duty imposed by Article
3(1)(a) of the Education and Libraries (Northern Ireland) Order 1986 to designate one of its officers as chief officer of the board shall ensure that a certificate issued is signed by that designated chief officer.
