The Department of the Environment, in exercise of the powers conferred on it by Articles 65(1) and (2), 67(1) and 110(2) of the Road Traffic (Northern Ireland) Order 1995(1) and of every other power enabling it in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Goods Vehicles (Testing) (Amendment) Regulations (Northern Ireland) 1998 and shall come into operation on 20th April 1998.
2.—(1) The Goods Vehicles (Testing) Regulations (Northern Ireland) 1995(2) shall be amended as provided in paragraphs (2) and (3).
(2) In regulation 2(1) (interpretation), in the definition of “agricultural motor vehicle”, after the word ““registered”,” there shall be inserted ““rigid vehicle”,”.
(3) For Schedule 1(3) there shall be substituted—

3. Regulation 2(2) of the Goods Vehicles (Testing) (Amendment) Regulations (Northern Ireland) 1996(4) is hereby revoked.

These Regulations further amend the Goods Vehicles (Testing) Regulations (Northern Ireland) 1995 as follows—
(1) A definition of “rigid vehicle” is inserted into regulation 2(1).
(2) Vehicles exceeding 3,500 kilograms maximum gross weight are now divided into 3 categories and the previous single fee of £32·50 payable on application for a first test, a periodical test, a re-test or an appeal is reduced as follows—
(a)for a 2 axle rigid vehicle £28; and
(b)for a 3 axle rigid vehicle £30.
For any other vehicle the fee remains unchanged at £32·50.
For a trailer the fee remains unchanged at £22.
The fees where an application for a re-test is made within 21 days from the date of service of a notice of refusal of a goods vehicle test certificate remain unchanged.
