Carriage of Dangerous Goods (Amendment) Regulations (Northern Ireland) 1998

The Department of Economic Development, being the Department concerned(1), in exercise of the powers conferred on it by Articles 17(1) to (6), 20(2), 40(2) and (4) and 55(2) of, and paragraphs 1(1) to (4) , 2, 3(1) and 5 of Schedule 3 to, the Health and Safety at Work (Northern Ireland) Order 1978(2) and of every other power enabling it in that behalf, after consultation in accordance with Article 46(1) of that Order with the Health and Safety Agency for Northern Ireland and such other bodies as appeared to the Department to be appropriate, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Carriage of Dangerous Goods (Amendment) Regulations (Northern Ireland) 1998 and shall come into operation on 30th December 1998.

Amendment to the Highly Flammable Liquids and Liquefied Petroleum Gases Regulations (Northern Ireland) 1975

2.  In regulation 7 (Liquefied petroleum gas—storage and marking of tanks, vessels, cylinders, etc) of the Highly Flammable Liquids and Liquefied Petroleum Gases Regulations (Northern Ireland) 1975(3), in paragraph 7(a), for the words “1st January 1999” there shall be substituted “1st July 2001”.

Amendments to the Dangerous Substances in Harbour Areas Regulations (Northern Ireland) 1991

3.  In the Dangerous Substances in Harbour Areas Regulations (Northern Ireland) 1991(4) in regulation 24 (Portable tanks and receptacles)–

(a)in paragraph (a)(i)(aa), for words “1st January 1999” there shall be substituted “1st July 2001”; and

(b)in paragraph (a)(i)(bb), for the words “31st December 1998” there shall be substituted “30th June 2001”.

Amendments to the Carriage of Dangerous Goods (Classification, Packaging and Labelling) and Use of Transportable Pressure Receptacles Regulations (Northern Ireland) 1997

4.  In the Carriage of Dangerous Goods (Classification, Packaging and Labelling) and Use of Transportable Pressure Receptacles Regulations (Northern Ireland) 1997(5)—

(a)in regulation 1 (Citation and commencement), in paragraph (2), for the words “1st January 1999” there shall be substituted “1st July 2001”;

(b)in regulation 3 (Application), in paragraph 4(e), for the words “1st January 1999” there shall be substituted “1st July 2001”; and

(c)in Schedule 8 (Requirements for transportable pressure receptacles manufactured before 1st January 1999 which are not covered by the Approved Requirements)–

(i)in the heading, for the words “1st JANUARY 1999” there shall be substituted “1st JULY 2001”;

(ii)in paragraph 3(5), for the words “31st December 1998” there shall be substituted “30th June 2001”;

(iii)in paragraph 4(1), for the words “1st January 1999” there shall be substituted “1st July 2001”;

(iv)in paragraph 4(2), for the words “1st January 1999” there shall be substituted “1st July 2001”;

(v)in paragraph 5(1), for the words “1st January 1999” there shall be substituted “1st July 2001”; and

(vi)in paragraph 5(2), for the words “1st January 1999” there shall be substituted “1st July 2001”.

Amendments to the Carriage of Dangerous Goods by Road Regulations (Northern Ireland) 1997

5.  In the Carriage of Dangerous Goods by Road Regulations (Northern Ireland) 1997(6)–

(a)in regulation 11 (Examination, testing and certification of tanks)–

(i)in paragraph (1)(a), for the words “1st January 1999” there shall be substituted “1st July 2001”; and

(ii)in paragraph (1)(b), for the words “31st December 1998” there shall be substituted “30th June 2001”;

(b)in Schedule 3 (Special requirements relating to tank containers and the tanks of road tankers constructed before 1st January 1999), in the heading, for the words “1st January 1999” there shall be substituted “1st July 2001”; and

(c)in Schedule 10 (Information to be displayed on containers, tanks and vehicles carrying dangerous goods), in paragraph 11, for the words “1st January 1999” there shall be substituted “1st July 2001”.

Amendments to the Carriage of Dangerous Goods by Rail Regulations (Northern Ireland) 1998

6.  In the Carriage of Dangerous Goods by Rail Regulations (Northern Ireland) 1998(7)–

(a)in regulation 2 (Application)–

(i)in paragraph (5), for the words “1st January 1999” there shall be substituted “1st July 2001”; and

(ii)in paragraph (7), for the words “1st January 1999” there shall be substituted “1st July 2001”;

(b)in regulation 9 (Examination, testing and certification of tanks), in paragraph (1), for the words “31st December 1998” there shall be substituted “30th June 2001”; and

(c)in Schedule 1 (Special requirements in relation to the tanks of tank containers and tank wagons constructed before 1st January 1999), in the heading, for the words “1st January 1999” there shall be substituted “1st July 2001”.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations further amend the Highly Flammable Liquids and Liquefied Petroleum Gases Regulations (Northern Ireland) 1975 (S.R. 1975 No. 256), the Dangerous Substances in Harbour Areas Regulations (Northern Ireland) 1991 (S.R. 1991 No. 509) and the Carriage of Dangerous Goods (Classification, Packaging and Labelling) and Use of Transportable Pressure Receptacles Regulations (Northern Ireland) 1997 (S.R. 1997 No. 247); they also amend the Carriage of Dangerous Goods by Road Regulations (Northern Ireland) 1997 (S.R. 1997 No. 248) and the Carriage of Dangerous Goods by Rail Regulations (Northern Ireland) 1998 (S.R. 1998 No. 131) to change the date for the application of certain provisions relating to tanks and transportable pressure receptacles from 1st January 1999 to 1st July 2001.
