Olive Oil (Marketing Standards) (Amendment) Regulations (Northern Ireland) 1998

The Department of Health and Social Services for Northern Ireland, being a designated Department(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by the said section 2(2) and of all other powers enabling it in that behalf, hereby makes the following Regulations:–

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Olive Oil (Marketing Standards) (Amendment) Regulations (Northern Ireland) 1998 and shall come into operation on 14th December 1998.

(2) In these Regulations “the principal Regulations” means the Olive Oil (Marketing Standards) Regulations (Northern Ireland) 1987(3).

Amendment of the principal Regulations

2.—(1) In regulation 2(1) of the principal Regulations, after the definition of “authorised officer” there shall be inserted–

“the Commission Regulation” means Commission Regulation (EEC) No. 2568/91 on the characteristics of olive oil and olive-residue oil and on the relevant methods of analysis(4), as amended up to and including the amendments effected by Commission Regulation (EC) No. 282/98(5);.

(2) In regulation 2(1) of the principal Regulations, in the definition of “the Council Regulation”, for “in particular by Council Regulation (EEC) No. 1915/87 and (EEC) No. 356/92” there shall be substituted “up to and including the amendments effected by Council Regulation (EC) No. 1638/98(6)”.

(3) In each of regulations 3(1), 3(3) and 5A of the principal Regulations, for “Commission Regulation (EEC) No. 2568/91 (as amended)” there shall be substituted “the Commission Regulation”.

(4) Regulation 3(2) of the principal Regulations shall be deleted.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the Olive Oil (Marketing Standards) Regulations (Northern Ireland) 1987 by–

(a)bringing up to date references to amendments to Council Regulation (EEC) No. 136/66 so as to cover reference to amendments up to and including those effected by Council Regulation (EC) No. 1638/98 (which in particular substitutes a revised specification for oils which may be sold as, or as particular types of, virgin olive oils),

(b)bringing up to date amendments to Commission Regulation 2568/91 in relation to analysis of olive oil, and

(c)deleting a spent provision.
