EDUCATION

The Education (Student Loans) (Amendment) Regulations (Northern Ireland) 1998

The Department of Education, in exercise of the powers conferred on it by Article 3(2) of the Education (Student Loans) (Northern Ireland) Order 1990(1), and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Education (Student Loans) (Amendment) Regulations (Northern Ireland) 1998 and shall come into operation on 24th February 1998.

Amendment of the Education (Student Loans) Regulations (Northern Ireland) 1997

2.  In the Schedule to the Education (Student Loans) Regulations (Northern Ireland) 1997(2) after paragraph 4 there shall be inserted the following paragraph—

4A.  Paragraph 1(b) shall not apply if—

(a)the relevant date was before 1st August 1997; or

(b)before 1st August 1997 the student commenced attending a course in respect of which he was eligible for a loan, and

(i)disregarding any intervening vacation immediately after ceasing to attend that course commenced attending his present course; or

(ii)in like fashion commenced attending another course or courses one after the other in respect of each of which he was eligible for a loan, until in like fashion he commenced attending his present course..

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the Education (Student Loans) Regulations (Northern Ireland) 1997 (“the principal Regulations”) and come into operation on 24th February 1998.

The principal Regulations included a new condition of eligibility for student loans. Subject to some exceptions a student is now required to be settled in the United Kingdom within the meaning of the Immigration Act 1971. The amending Regulations provide that this condition shall not apply to students who began their courses before 1st August 1997, or who from before then and without break have been attending courses for which they have been eligible for loans.
