Coming into operation

The Department of Education, in exercise of the powers conferred on it by Article 5(3) of the Education (Northern Ireland) Order 1996(1) and of every other power enabling it in that behalf, hereby makes the following Order:
1. This Order may be cited as the Education (Special Educational Needs Code of Practice) (Appointed Day) (Northern Ireland) Order 1998 and shall come into operation on 1st September 1998.
2. 1st September 1998 is hereby appointed as the day on which the Code of Practice on the Identification and Assessment of Special Educational Needs issued pursuant to Article 5(3) of the Education (Northern Ireland) Order 1996 in 1998 shall come into force.

This Order appoints 1st September 1998 as the day on which the Code of Practice on the Identification and Assessment of Special Educational Needs issued in 1998 shall come into force. This Code of Practice (pursuant to Article 4 of the Education (Northern Ireland) Order 1996 (“the 1996 Order”)) gives practical guidance in respect of the discharge by Education and Library Boards and the Boards of Governors of grant-aided schools of their functions under Part II of the 1996 Order (which relates to children with special educational needs).
Copies of the Code of Practice on the Identification and Assessment of Special Educational Needs can be obtained from the Department of Education, Rathgael House, 43 Balloo Road, Bangor, Co. Down BT19 7PR.
