The Department of Health and Social Services, in exercise of the powers conferred on it by Article 36(1) and (2)(a) of, and paragraphs 4 and 10 of Schedule 1 to, the Jobseekers (Northern Ireland) Order 1995(1), and of all other powers enabling it in that behalf, hereby makes the following Regulations:
1.—(1) These Regulations may be cited as the Jobseeker’s Allowance (Amendment) Regulations (Northern Ireland) 1998 and shall come into operation on 5th April 1999.
(2) In these Regulations, “the Jobseeker’s Allowance Regulations” means the Jobseeker’s Allowance Regulations (Northern Ireland) 1996(2).
2. In regulation 46(2) of the Jobseeker’s Allowance Regulations (waiting days), for “3” there shall be substituted “7”.
3. In regulation 141(2) of the Jobseeker’s Allowance Regulations(3) (circumstances in which an income-based jobseeker’s allowance is payable to a person in hardship), for “4th” there shall be substituted “8th”.
4. Regulations 2 and 3 shall not apply in the case of a person—
(a)who has made a claim for a jobseeker’s allowance before 5th April 1999 or who is treated as having made a claim for a jobseeker’s allowance before that date, and
(b)in respect of whom 5th April 1999 is one of the first 3 days of a jobseeking period.

These Regulations amend the Jobseeker’s Allowance Regulations (Northern Ireland) 1996 by increasing the number of waiting days before which a person may be entitled to a jobseeker’s allowance from 3 to 7 (regulation 2).
Regulation 3 makes a consequential amendment and regulation 4 makes a transitional provision.
These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Social Security in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992 (c. 8), are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.
