Road Transport Licensing (Fees) Regulations (Northern Ireland) 1997

To be laid before Parliament under paragraph 3(3) of Schedule 1 to the Northern Ireland Act 1974

Coming into operation

The Department of the Environment, in exercise of the powers conferred by sections 9, 16(2), 23(2) and 25(2) and (4) of the Transport Act (Northern Ireland) 19671, and now vested in it2 and of every other power enabling it in that behalf, and with the approval of the Department of Finance and Personnel3, hereby makes the following Regulations:

Citation, commencement and interpretation1

These Regulations may be cited as the Road Transport Licensing (Fees) Regulations (Northern Ireland) 1997 and shall come into operation on 1st April 1997.

In these Regulations, “the Act” means the Transport Act (Northern Ireland) 1967.

Fees for road service licences2

The fee payable for a road service licence under section 9(1) of the Act shall be calculated in respect of each vehicle authorised to be used under the licence at the rate of £3·25 per month (or part of a month) for each month that the licence is to remain in force.

Refund of road service licence fees3

Where a road service licence is surrendered, revoked or suspended the holder shall be entitled under section 9(2) of the Act to be repaid by way of rebate of the fee paid in respect of the grant of the licence—

a

for each complete month of the period of currency of the licence which is unexpired at the time of surrender or revocation; or

b

for each complete month of the period during which the licence is suspended,

a sum equal to the monthly multiplicand in respect of each vehicle authorised under the licence.

For the purposes of this regulation “the monthly multiplicand” means the rate per month at which the fee paid under regulation 2 by the holder of the licence was calculated.

Fees for road freight operators' licences4

The fee payable for a road freight operator’s licence under section 16(2) of the Act shall be £7·00 for each complete year during which the licence is to remain in force.

Alteration of road freight vehicle licence fees5

The amount of the fee payable for a road freight vehicle licence under section 23(1) of the Act shall be £4·00, instead of £3·00, for each month or part of a month during the currency of the licence.

The amount of the fee payable for such a licence under section 25(2) or (4) of the Act shall be £2·50.

Revocation6

The Regulations set out in the Schedule are hereby revoked.

These Regulations revoke and re-enact, with amendments, the Road Transport Licensing (Fees) Regulations (Northern Ireland) 1985, and all subsequent amendments.

The only amendments are increases in fees as follows—

a

for a road service licence, the fee is increased from £2·55 to £3·25 (per month or part of month) (regulation 2);

b

for a road freight operator’s licence, the fee is increased from £5·00 to £7·00 (per year) (regulation 4); and

c

for a road freight vehicle licence, the fee is increased from £3·00 to £4·00 (per month or part of a month) (regulation 5(1)).

The Regulations set out in the Schedule are revoked as a consequence of these Regulations.
