The Department of Agriculture, in exercise of the powers conferred on it by Article 7(1) and (2) of the Diseases of Animals (Northern Ireland) Order 1981(1) and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Zoonoses Order (Northern Ireland) 1997 and shall come into operation on 24th December 1997.

Interpretation

2.  In this Order—

“animals” means bovine animals, sheep, goats, deer and all other ruminant animals; and

“the 1981 Order” means the Diseases of Animals (Northern Ireland) Order 1981.

Designation of spongiform encephalopathies for the purposes of Article 7 of the 1981 Order

3.—(1) Bovine spongiform encephalopathy, being a disease which is carried in animals and constitutes in the opinion of the Department, a risk to human health, is hereby designated for the purposes of Article 7 of the 1981 Order.

(2) The provisions of the 1981 Order listed in the Schedule to this Order shall have effect for the purpose of preventing the spread of the disease designated under paragraph (1) to or among humans as they have effect for the purpose of preventing the spread of that disease among animals.

Explanatory Note

(This note is not part of the Order.)

Article 7 of the Diseases of Animals (Northern Ireland) Order 1981 (“the 1981 Order”) empowers the Department, with a view to reducing the risk to human health from any disease carried in animals or poultry, to make an Order designating any disease which, in its opinion, constitutes such a risk and to apply any provision of the 1981 Order to that disease.

This Order designates bovine spongiform encephalopathy for the purposes of Article 7 (Article 3(1)) and applies certain provisions of the 1981 Order to bovine spongiform encephalopathy with a view to preventing the spread of that disease to or among humans (Article 3(2) and the Schedule).
