EMPLOYMENT

Employment (Miscellaneous Provisions) (1990 Order) (Commencement No. 2) Order (Northern Ireland) 1997

The Department of Economic Development, in exercise of the powers conferred on it by Article 1(3) of the Employment (Miscellaneous Provisions) (Northern Ireland) Order 1990(1), and of every other power enabling it in that behalf, hereby makes the following Order:

Citation

1.  This Order may be cited as the Employment (Miscellaneous Provisions) (1990 Order) (Commencement No. 2) Order (Northern Ireland) 1997.

Commencement

2.  The day hereby appointed for the coming into operation of the Employment (Miscellaneous Provisions) (Northern Ireland) Order 1990, so far as not already in operation, is 24th August 1997.

Explanatory Note

(This note is not part of the Order.)

This Order brings into operation on 24th August 1997 all the provisions of the Employment (Miscellaneous Provisions) (Northern Ireland) Order 1990 (“the 1990 Order”) which are not already in operation, these being provisions for the repeal of section 117A of the Factories Act (Northern Ireland) 1965 (which relates to the duty of a factory occupier to give notice of employment of a young person to the local office of the Training and Employment Agency) and enactments related to it.

Note as to Earlier Commencement Orders

In the commencement provisions of the 1990 Order, Article 1(2) provides that the provisions of the Order, with the exception of those specified in Article 1(3), shall come into operation 2 months after making of the Order, i.e. 15th April 1990.

Article 1(3) provides that the provisions of the Order contained therein shall be brought into operation on such day as the Department shall appoint. That Commencement Order (S.R. 1990 No. 277 (C. 11)) brought into operation, on 1st September 1990, Article 11(5) of the 1990 Order which relates to a prohibition of employment of women in a job requiring a significant proportion of that employee’s time to be spent underground.
