Motor Hackney Carriages (Belfast) (Amendment) By-Laws (Northern Ireland) 1997

The Department of the Environment, in exercise of the powers conferred on it by Article 65(1) and (2) of the Road Traffic (Northern Ireland) Order 1981(1) and of every other power enabling it in that behalf, hereby makes the following By-Laws:
Citation and commencement
1. These By-Laws may be cited as the Motor Hackney Carriages (Belfast) (Amendment) By-Laws (Northern Ireland) 1997 and shall come into operation on 22nd September 1997.
By-Laws amended
2.—(1) The By-Laws made in respect of Motor Hackney Carriages standing or plying for hire made by the Council of the County Borough of Belfast on 4th June 1951(2) shall be amended in accordance with paragraphs (2) and (3).
(2) For By-Law 9 there shall be substituted—
“9. The several streets specified in the first column of the Schedule to these By-Laws annexed shall at the sites specified in column 2 of said Schedule be the prescribed public street stands for Motor Hackney Carriages not exceeding the number specified in column 3 of the said Schedule. The hours available for use of the prescribed public street stands by Motor Hackney Carriages shall be the times specified in column 4 of the said Schedule.
A vehicle other than a licensed Motor Hackney Carriage standing or plying for hire shall not wait on any such prescribed public street stands during the times specified in column 4 of the said Schedule.”.
(3) For the Schedule there shall be substituted—

Revocation
3. The Motor Hackney Carriages (Belfast) (Amendment No. 3) By-Laws (Northern Ireland) 1996(3) are hereby revoked.

Explanatory Note
(This note is not part of the By-Laws.)
These By-Laws revoke and replace with amendments By-Law 9 of and the Schedule to the Motor Hackney Carriages (Belfast) By-Laws made by the Council of the County Borough of Belfast on 4th June 1951.
The amendments are as follows—
By-Law 9 now makes reference to the hours available for the use of taxi stands by taxis, and prohibits the waiting by a vehicle (other than a licensed taxi) on taxi stands during these hours.
The new Schedule makes provision for new taxi stands at Fisherwick Place, Great Victoria Street and Bradbury Place. The existing stands on the west and east side of Malone Road have been relocated and the number of spaces on the west side increased from two to four. The existing stand at Oxford Street has been removed.
The Motor Hackney Carriages (Belfast) (Amendment No. 3) By-Laws (Northern Ireland) 1996 are revoked as a consequence of these By-Laws.
