LEGAL AID AND ADVICE

1.—(1) These Regulations may be cited as the Legal Aid (Assessment of Resources) (Amendment) Regulations (Northern Ireland) 1997 and shall come into operation on 18th August 1997.
(2) In these Regulations, a Schedule referred to by number means the Schedule so numbered in the Legal Aid (Assessment of Resources) Regulations (Northern Ireland) 1981(3).
2. These Regulations shall apply to all determinations and re-determinations made on or after 18th August 1997.
3. Rule 6 of Schedule 1 shall be amended by adding after sub-paragraph (d) the following sub-paragraph—
“(e)a payment made under Article 15A of the Health and Personal Social Services (Northern Ireland) Order 1972(4).”.
4. Rule 6B of Schedule 2 shall be amended by adding after sub-paragraph (b), the following sub-paragraph—
“(c)any arrears of payments made under Article 15A of the Health and Personal Social Services (Northern Ireland) Order 1972.”.

These Regulations amend the Legal Aid (Assessment of Resources) Regulations (Northern Ireland) 1981 to provide that a payment made under Article 15A of the Health and Personal Social Services (Northern Ireland) Order 1972 shall be disregarded in computing disposable income and capital.
