6.—(1) In regulation 32 of the Income Support Regulations(1) (calculation of weekly amount of income) after paragraph (6) there shall be inserted the following paragraph—
“(6A) Where income is taken into account under regulation 29(2A)(2) (calculation of earnings derived from employed earners employment and income other than earnings) over the period specified in that paragraph, the amount of that income to be taken into account in respect of any week in that period shall be an amount equal to the amount of that income which would have been taken into account under regulation 62 (calculation of grant income) had the person to whom that income was paid not ceased to be a student.”.
(2) In regulation 97 of the Jobseeker’s Allowance Regulations (calculation of weekly amount of income) after paragraph (6) there shall be added the following paragraph—
“(7) Where income is taken into account under regulation 94(2A)(3) (calculation of earnings derived from employed earners employment and income other than earnings) over the period specified in that paragraph, the amount of that income to be taken into account in respect of any week in that period shall be an amount equal to the amount of that income which would have been taken into account under regulation 131 (calculation of grant income) had the person to whom that income was paid not ceased to be a full-time student.”.
