The Northern Ireland Disability Council Regulations (Northern Ireland) 1997

The Department of Health and Social Services, in exercise of the powers conferred on it by section 67(1) of, and paragraphs 4(4) and 7(d) of Schedule 5(2) to, the Disability Discrimination Act 1995(3), and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Northern Ireland Disability Council Regulations (Northern Ireland) 1997 and shall come into operation on 12th May 1997.

(2) In these Regulations—

“the Council” means the Northern Ireland Disability Council established under section 50(1)(4) of the Disability Discrimination Act 1995; and

“the Department” means the Department of Health and Social Services.

(3) The Interpretation Act (Northern Ireland) 1954(5) shall apply to these Regulations as it applies to a Measure of the Northern Ireland Assembly.

Removal from office of a member of the Council

2.  The Department may remove a member of the Council from office in any of the following circumstances—

(a)where he has, throughout a continuous period of 6 months ending not earlier than 3 months before the date on which the removal takes effect, failed, without the consent of the Council, to attend meetings of the Council;

(b)where he is an undischarged bankrupt or is otherwise unable to pay his debts; and

(c)where he is incapable of discharging the functions of his office or has been guilty of misbehaviour.

Expenses of the Council

3.  The Department may, with the approval of the Department of Finance and Personnel, pay expenses of the Council which it is satisfied were reasonably incurred.

Revocation

4.  The Northern Ireland Disability Council Regulations (Northern Ireland) 1996(6) are hereby revoked.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations revoke and replace the Northern Ireland Disability Council Regulations (Northern Ireland) 1996. Those Regulations were erroneously made, in part, under section 67 of, as modified by Schedule 8 to, the Disability Discrimination Act 1995 before that section was brought into operation.

These Regulations prescribe the circumstances in which a member of the Northern Ireland Disability Council established by section 50 of, as modified by Schedule 8 to, the Disability Discrimination Act 1995 may be removed from office by the Department of Health and Social Services (regulation 2). They also make provision for the expenses incurred by the Council to be paid by the Department of Health and Social Services with the approval of the Department of Finance and Personnel (regulation 3).
