The Department of Economic Development and the Department of Agriculture, acting jointly as the Department concerned(1), in exercise of the powers conferred on them by Articles 17(1) and (3) and 55(2) of the Health and Safety at Work (Northern Ireland) Order 1978(2) and of every other power enabling them in that behalf, after consultation in accordance with Article 46(1) of that Order with the Health and Safety Agency for Northern Ireland and such other bodies as appeared to them to be appropriate, hereby make the following Regulations:—
1. These Regulations may be cited as the Health and Safety (Repeals and Modifications) Regulations (Northern Ireland) 1997 and shall come into operation on 21st April 1997.
2. Sections 6, 12, 17, 18 and 19 of the Agriculture (Safety, Health and Welfare Provisions) Act (Northern Ireland) 1959(3) are hereby repealed.
3. In regulation 2(1) of the Agriculture (Field Machinery) Regulations (Northern Ireland) 1985(4) for the definition of “the Department” there shall be substituted—
““the Department” means the Department of Economic Development;”.
4. In regulation 2(1) of the Agriculture (Safeguarding of Workplaces) Regulations (Northern Ireland) 1989(5) for the definition of “the Department” there shall be substituted—
““the Department” means the Department of Economic Development;”.
5. In regulation 2 of the Agriculture (Circular Saws) Regulations (Northern Ireland) 1989(6) for the definition of “the Department” there shall be substituted—
““the Department” means the Department of Economic Development;”.
6. In regulation 2(1) of the Agriculture (Tractor Cabs) Regulations (Northern Ireland) 1993(7) for the definition of “the Department” there shall be substituted—
““the Department” means the Department of Economic Development;”.

These Regulations repeal sections 6, 12, 17, 18 and 19 of the Agriculture (Safety, Health and Welfare Provisions) Act (Northern Ireland) 1959 (regulation 2).
The Agriculture (Field Machinery) Regulations (Northern Ireland) 1985 (S.R. 1985 No. 11) are amended so that the Department of Economic Development, instead of the Department of Agriculture, has discretion to grant certificates of exemption from the provisions of those Regulations (regulation 3).
The Agriculture (Safeguarding of Workplaces) Regulations (Northern Ireland) 1989 (S.R. 1989 No. 309) are amended so that the Department of Economic Development, instead of the Department of Agriculture, has discretion to grant certificates of exemption from the provisions of those Regulations (regulation 4).
The Agriculture (Circular Saws) Regulations (Northern Ireland) 1989 (S.R. 1989 No. 413) are amended so that the Department of Economic Development, instead of the Department of Agriculture, has discretion to grant certificates of exemption from the provisions of those Regulations (regulation 5).
The Agriculture (Safety Cabs) Regulations (Northern Ireland) 1993 (S.R. 1993 No. 477) are amended so that the Department of Economic Development, instead of the Department of Agriculture, has discretion to approve safety cabs for use with tractors, and to grant certificates of exemption from the provisions of those Regulations (regulation 6).
