The Department of Health and Social Services, in exercise of the powers conferred on it by Articles 56, 61, 62, 63 and 106 of, and paragraph 8(5) of Schedule 1 to, the Health and Personal Social Services (Northern Ireland) Order 1972(1) and Article 10 of the Health and Medicines (Northern Ireland) Order 1988(2) and of all other powers enabling it in that behalf, and after consultation with such organisations as appeared to the Department to be representative of the medical, dental, ophthalmic and pharmaceutical professions as required by Articles 56(5), 61(4), 62(3) and 63(3) of the said Order, hereby makes the following regulations:—
1.—(1) These Regulations may be cited as the Health and Personal Social Services (Disciplinary Procedures) (Amendment) Regulations (Northern Ireland) 1997 and shall come into operation on 1st April 1997.
(2) In these Regulations “the principal Regulations” means the Health and Personal Social Services (Disciplinary Procedures) Regulations (Northern Ireland) 1996(3).
2. In regulation 4 of the principal Regulations (provisions relating to the start of disciplinary proceedings), in paragraph (3) for “paragraph 2(b)” there shall be substituted “paragraph (2)(a)”.

These Regulations amend the Health and Personal Social Services (Disciplinary Procedures) Regulations (Northern Ireland) 1996 (“the principal Regulations”).
Regulation 2 amends regulation 4(3) of the principal Regulations in relation to the action which the Board shall not take while a complaint is being investigated.
