POLICE

The Royal Ulster Constabulary Reserve (Full-Time) Pensions (Amendment) Regulations 1996

The Secretary of State, in pursuance of section 26 of the Police Act (Northern Ireland) 1970(1), and after consulting, in accordance with section 34(2) of that Act, the Police Authority and the Police Association, hereby with the concurrence of the Treasury makes the following regulations:—

Citation and commencement

1.  These regulations may be cited as the Royal Ulster Constabulary Reserve (Full-Time) Pensions (Amendment) Regulations 1996 and shall come into operation on 1st February 1996.

Modification of provisions applied to reserve members

2.—(1) Regulation 4 of the Royal Ulster Constabulary Reserve (Full-Time) Pensions Regulations 1994(2) shall be amended in accordance with paragraphs (2) and (3).

(2) There shall be inserted after paragraph (5) the following paragraphs—

(5A) Regulation B8(1) shall have effect as if for the words “does not exceed £140” there were substituted the words “does not exceed £260, or any greater amount prescribed by regulations for the time being in force under paragraph 15(4) of Schedule 3 to the Social Security Pensions (Northern Ireland) Order 1975(3),”.

(5B) Regulation E4(3) shall have effect as if for the words “does not exceed £104” there were substituted the words “does not exceed £260, or any greater amount prescribed by regulations for the time being in force under paragraph 15(4) of Schedule 3 to the Social Security Pensions (Northern Ireland) Order 1975,”.

(5C) Regulation E8 shall have effect as if—

(a)in paragraph (2)(a) for the words “pensionable pay” there were substituted the words “relevant emoluments”; and

(b)there were inserted after paragraph (2) the following paragraph—

(2A) For the purposes of paragraph (2)(a) a member’s relevant emoluments for a week are—

(a)his pensionable pay for the week, and

(b)so much as is attributable to the week of any allowances to which he was entitled under the Schedule to the Royal Ulster Constabulary Reserve (Full-Time) (Appointment and Conditions of Service) (Amendment No. 3) Regulations 1994(4)...

(3) There shall be added after paragraph (7) the following paragraph—

(8) Regulation J1(7) of the principal regulations shall have effect as if for the words “does not exceed £104” there were substituted the words “does not exceed £260, or any greater amount prescribed by regulations for the time being in force under paragraph 15(4) of Schedule 3 to the Social Security Pensions (Northern Ireland) Order 1975,”..

Explanatory Note

(This note is not part of the Regulations.)

These regulations amend the Royal Ulster Constabulary Reserve (Full-Time) Pensions Regulations 1994 by inserting new paragraphs in regulation 4 of those regulations.

New paragraphs (5A), (5B) and (8) cater for increases made in certain maxima by the Occupational Pension Schemes (Preservation of Benefit) Regulations (Northern Ireland) 1991 (S.R. 1991 No. 37) and for any future increases in them. New paragraph (5C) augments the increased pension payable during the first 13 weeks of widowhood by adding to it the equivalent of any replacement allowances in lieu of the former housing or similar allowances that had been payable to the deceased.
