5. In rule 1 after paragraph (3) there shall be added the following paragraph—
“(3A) Paragraph (1)(b) does not apply to an originating application in respect of an application under Article 5C of the Employment (Miscellaneous Provisions) (Northern Ireland) Order 1981(1) for the variation or revocation of a prohibition order, but on any such application the Department shall be treated as the respondent for the purpose of these Rules”.
