Plant Protection Products (Amendment) Regulations (Northern Ireland) 1996

The Department of Agriculture, being a Department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by the said section 2(2) and of every other power enabling it in that behalf, hereby makes the following Regulations:—

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Plant Protection Products (Amendment) Regulations (Northern Ireland) 1996 and shall come into operation on 1st November 1996.

(2) The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to a Measure of the Northern Ireland Assembly.

Amendment of the Plant Protection Products Regulations (Northern Ireland) 1995

2.  Regulation 2(1) of the Plant Protection Products Regulations (Northern Ireland) 1995(4) shall be amended by substituting for the definition of “the Directive” the following definition—

• ““the Directive” means Council Directive 91/414/EEC concerning the placing of plant protection products on the market as amended by—

  (a)

  Commission Directive 93/71/EEC

  (b)

  Commission Directive 94/37/EC

  (c)

  Commission Directive 94/79/EC

  (d)

  Commission Directive 95/35/EC

  (e)

  Commission Directive 95/36/EC”

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the Plant Protection Products Regulations (Northern Ireland) 1995 which implement Council Directive 91/414/EEC concerning the placing of plant protection products on the market (“the Directive”), as amended by Commission Directive 93/71/EEC, Commission Directive 94/37/EEC and Commission Directive 94/79/EC, each of which amends Annexes II and III to the Directive.

The Regulations amend the definition of the Directive provided in the Plant Protection Products Regulations (Northern Ireland) 1995 in consequence of Commission Directive 95/35/EC (O.J. No. L172, 22.7.95, p. 6) and Commission Directive 95/36/EC (O.J. No. L172, 22.7.95, p. 8), each of which amends Annexes II and III to the Directive, and of the annulment by the European Court of Justice of Council Directive 94/43/EEC, which established Annex VI to the Directive, in its judgement of 18th June 1996 in Case C-303/94 (European Parliament-v-Council of the European Union).
