The Family Law (1993 Orders) (Commencement No. 1) Order (Northern Ireland) 1996

The Department Finance and Personnel, in exercise of the powers conferred on it by Article 1(3) and (5) of the Family Law (Northern Ireland) Order 1993(1) and paragraph 2(1) of Schedule 1 to the Northern Ireland Act 1974(2) and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation

1.  This Order may be cited as the Family Law (1993 Orders) (Commencement No. 1) Order (Northern Ireland) 1996.

Interpretation

2.  In this Order—

“the Consequential Amendments Order” means the Family Law (Northern Ireland Consequential Amendments) Order 1993(3);

“the Family Law Order” means the Family Law (Northern Ireland) Order 1993.

Appointed day: commencement of maintenance enforcement provisions

3.  Articles 6 to 11 of and Schedule 1 (except paragraphs 10 to 12 and 15) to the Family Law Order and the Consequential Amendments Order shall come into operation on 4th November 1996.

Explanatory Note

(This note is not part of the Order.)

This Order brings into operation on 4th November 1996 the maintenance enforcement provisions contained in Articles 6 to 11 of and Schedule 1 to the Family Law (Northern Ireland) Order 1993 (“the Family Law Order”) and in the Family Law (Northern Ireland Consequential Amendments) Order 1993.

Paragraphs 10 to 12 and 15 of and Schedule 1 to the Family Law Order are not brought into operation by the Order: these provisions have been repealed and replaced by other provisions in the Children (Northern Ireland) Order 1995 (S.I. 1995/755 (N.I. 2)), which provisions also come into operation on 4th November 1996.

Articles 1 to 4, 12 to 14 and 16 of, and Schedules 2 to 4 to, the Family Law Order came into operation in accordance with Article 1(2) of the Family Law Order on 24th August 1993. Articles 5 and 15 have not been brought into operation.
