Specified Bovine Material (No. 2) Order (Northern Ireland) 1996

Explanatory Note

(This note is not part of the Order.)

This Order revokes and re-enacts the Specified Bovine Material Order (Northern Ireland) 1996 and the Specified Bovine Material Amendment Order (Northern Ireland) 1996. This Order controls specified bovine material and as such implements various EC Directives first mentioned in the Specified Bovine Offal Order (Northern Ireland) 1995.

The only changes of substance are:

(a) the introduction of certain restrictions on the use, storage, packaging and consignment of mammalian meat and bone meal, including a requirement to keep records relating to production, transport and use of such meal (Article 4(4)—(18));

(b) requiring that any solid matter resulting from the slaughter of bovine animals which is found in a drainage trap of the slaughterhall of a slaughterhouse is to be dealt with in the same way as specified bovine material (Article 2(1)).

Any person who without lawful authority or excuse, proof of which shall lie on him, contravenes any provision of the Order shall be guilty of an offence against the Diseases of Animals (Northern Ireland) Order 1981. The penalty on summary conviction is in the case of an offence committed in relation to carcases or other inanimate things, a fine at level 5 on the standard scale (currently £5,000) together with a further fine at level 3 on the standard scale (currently £1,000) in respect of every 508 kilogrammes in weight of the carcases or other things after the first 508 kilogrammes.
