REGISTRATION OF BIRTHS, DEATHS AND MARRIAGES

Births, Deaths and Marriages (Fees) Order (Northern Ireland) 1992

To be laid before Parliament under paragraph 3(3) of Schedule 1 to the Northern Ireland Act 1974

In exercise of the powers conferred upon me by section 1 of the Registration of Births, Deaths and Marriages (Fees, etc.) Act (Northern Ireland) 1955(1) as modified by section 40 of, and paragraph 4 of Schedule 5 to, the Northern Ireland Constitution Act 1973(2), Article 47 of the Births and Deaths Registration (Northern Ireland) Order 1976(3), Article 15 of the Financial Provisions (Northern Ireland) Order 1976(4) and section 9 of the Marriage Act 1983(5) I hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Births, Deaths and Marriages (Fees) Order (Northern Ireland) 1992 and shall come into operation on 1st July 1992.

Fees payable

2.  For the amounts of the fees payable under the several enactments set forth in column 1 of the Schedule in respect of the services described in column 2 and specified respectively in column 3, there shall be substituted the increased amounts specified respectively in column 4 thereof.

Fees for services under the Marriage Act 1983

3.—(1) Any fee payable for a service provided under those provisions of the Marriage Act 1983 set forth in column 1 of the Schedule being a service described in column 2, shall be payable by the person who gives notice of intention to marry under section 3(2) of that Act, except that no such fee shall be payable by any person who is in receipt of benefit under section 122(1)(a) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992(6).

(2) Any fee payable by virtue of paragraph (1) shall be payable to the Registrar General.

Revocation of Order

4.  The Births, Deaths and Marriages (Fees) Order (Northern Ireland) 1989(7) is hereby revoked.

Explanatory Note

(This note is not part of the Order.)

This Order increases various fees payable under the Births, Deaths and Marriages enactments relating to:

(a) licences and other preliminary proceedings for marriage;

(b) registration for marriage purposes of meeting houses and other places of worship;

(c) registration of births, deaths and marriages.

It provides by whom and to whom fees are payable for services under the Marriage Act 1983 and exempts any person in receipt of income support from payment for those services.
