The Statutory Officers (District Judge) (Northern Ireland) Order 1991

The Lord Chancellor, in exercise of the powers conferred on him by section 70(5) and (6) of the Judicature (Northern Ireland) Act 1978(1), after consultation with the Lord Chief Justice, hereby makes the following Order:—

Citation, commencement and interpretation

1.  —

(1) This Order may be cited as the Statutory Officers (District Judge) (Northern Ireland) Order 1991 and shall come into operation on 28th June 1991.

(2) In this Order:

  • “statutory provision” has the meaning assigned to it by section 1(f) of the Interpretation Act (Northern Ireland) 1954(2) ; and

  • “statutory document” has the meaning assigned to it by section 1(e) of the Interpretation Act (Northern Ireland) 1954.

District Judge

2.  Schedule 3 to the Judicature (Northern Ireland) Act 1978 shall be modified by amending in column 1 or the title of the office of Circuit Registrar to substitute for that title the title District Judge and by inserting in column 4, after the words “District Probate Registrar”, the words “Circuit Registrar”.

Construction of Enactments

3.  Any reference in any statutory provision, statutory document or other document to “circuit registrar” or “deputy circuit registrar” shall be construed as a reference to “district judge” or “deputy district judge” respectively.

Explanatory Note

(This note is not part of the Order.)

This Order amends Schedule 3 to the Judicature (Northern Ireland) Act 1978 to substitute for the title of the office of Circuit Registrar the title District Judge. It also provides that in any statutory provision or document a reference to a circuit registrar or a deputy circuit registrar shall be construed as a reference to a district judge or deputy judge respectively.
