39.—(1) The [F1RQIA] may serve a notice (an “improvement notice”) on a person registered under Part III or on [F2an] [F3HSC trust] or special agency if the Authority believes that that person, F4... trust or agency is failing to comply with any statement of minimum standards under Article 38.
(2) An improvement notice shall specify—
(a)in what respect there is a failure to comply with a statement of minimum standards under Article 38; and
(b)what improvements the [F1RQIA] considers necessary.
