2.  In Article 22D(4) (dismissal on grounds of assertion of statutory right), after sub-paragraph (b)(ii) add—

“or

(iii) the rights conferred by Articles 42, 43, and 46 of the Pensions (Northern Ireland) Order 1995.”.
