NORTHERN IRELAND

This Order, in Articles 2 to 31, implements the recommendations in Part 5 of the Final Report of the Land Law Working Group (HMSO 1990) about the law of succession on death and, in particular, the law of wills. Those Articles contain substantial re-enactments of relevant provisions of the Wills Act 1837, and also contain new provisions—empowering a minor to make a will if he is, or has been, married (Article 4);about the execution of a will (Article 5);about the effect of the testator’s marriage (Article 12);about the effect of marriage breakdown (Article 13);for contingent and future gifts to carry intermediate income (Article 21);about gifts to children who predecease the testator (Article 22);about certain gifts to spouses (Article 23);about a gift of property subject to an option (Article 24);about the admission of extrinsic evidence to aid the construction of a will (Article 25);about the rectification of wills (Article 29); andabout commorientes (Article 30).
