Article 18.

SCHEDULE 1AMENDMENTS OF ORDER WHICH HAVE EFFECT ON COMING INTO OPERATION OF ARTICLE 34(11) OF THE FIRE SERVICES (NORTHERN IRELAND) ORDER 1984

1.  In Article 4(2), after the words “Article 6” there shall be inserted the words “and any regulations made or having effect as if made under Article 34 of the Fire Services (Northern Ireland) Order 1984”.

2.  In Article 8, for paragraph (3) there shall be substituted the following—

(3) The exemptions mentioned in Article 7(3) also have effect in relation to any film exhibition to which this Article applies. .

3.  The following provisions shall cease to have effect, namely—

(a)in Article 2(2), the definition of “the Fire Authority”;

(b)in Article 5—

(i)in paragraph (1), sub-paragraph (b);

(ii)in paragraph (2), the words “the Fire Authority and”;

(iii)in paragraph (3), the words “by the Fire Authority or”;

(c)Article 6(2)(a);

(d)in Article 9(1)(a), the words “, to the Fire Authority”;

(e)in Article 10(b) the words “, to the Fire Authority”;

(f)in Article 12, paragraphs (1)(d) and (2)(c);

(g)in Article 15—

(i)in paragraphs (1) and (6), the words “or of the Fire Authority”;

(ii)paragraphs (1)(b) and (2);

(iii)in paragraph (8), in the definition of “relevant provisions”, in sub-paragraph (a) the words “or (2)(a)”, sub-paragraph (b) and in sub-paragraph (c) the words “or (2)(b)”;

(h)in Article 16(3), the words “the Fire Authority and” and the words “that Authority and”.

SCHEDULE 2CONSEQUENTIAL AMENDMENTS

The Uniformity of Laws Act (Northern Ireland) 1922 (c. 20)

1.  In the Fifth Schedule (which sets out the Celluloid and Cinematograph Film Act 1922) in paragraph (iii) of the proviso to section 2 of that Act for the words “the Cinematograph Act 1909” there shall be substituted the words “Article 3 of the Cinemas (Northern Ireland) Order 1991”.

The Fire Services (Northern Ireland) Order 1984 (NI 11)

2.  In Article 34(11) for the words “by virtue of section 2(2)(a) of the Cinematograph Act (Northern Ireland) 1959 under the Cinematograph Act 1909” there shall be substituted the words “under Article 6(2)(a) of the Cinemas (Northern Ireland) Order 1991”.

The Video Recordings Act 1984 (c. 39)

3.—(1) In section 3(6)(b) for the words “an exempted exhibition within the meaning of section 5 of the Cinematograph Act (Northern Ireland) 1959” there shall be substituted the words “a film exhibition to which Article 8 of the Cinemas (Northern Ireland) Order 1991 applies”.

(2) For subsection (7) there shall be substituted the following subsection—

(7) The premises referred to in subsection (6) above are—

(a)premises in respect of which a licence under Article 3 of the Cinemas (Northern Ireland) Order 1991 is in force,

(b)premises falling within Article 9 of that Order (premises used only occasionally and exceptionally for film exhibitions), or

(c)premises falling within Article 10 of that Order (building or structure of a movable character) in respect of which such a licence as is mentioned in paragraph (1)(a) of that Article has been granted..

The Local Government (Miscellaneous Provisions) (Northern Ireland) Order 1985 (NI 15)

4.—(1) In Schedule 1 in paragraph 1(7)(a) for the words “the Cinematograph Act 1909” there shall be substituted the words “Article 3 of the Cinemas (Northern Ireland) Order 1991”.

(2) In Schedule 2 in paragraph 3 for sub-paragraph (2)

there shall be substituted the following sub-paragraph—

(2) No premises shall be treated as a sex cinema by reason only—

(a)if they are licensed under Article 3 of the Cinemas (Northern Ireland) Order 1991, of their use for a purpose for which a licence under that Article is required; or

(b)of their use for an exhibition to which Article 8 of that Order (certain non-commercial exhibitions) applies given by an exempted organisation within the meaning of Article 8(6) of that Order..
