Article 28(1).

1AMENDMENTS

The Conspiracy and Protection of Property Act 1875 (c. 86)

1.  In section 7 for the words from “shall” to the end substitute the words

shall be liable on summary conviction to imprisonment for a term not exceeding 6 months or a fine not exceeding level 5 on the standard scale or both.

A constable may arrest without warrant anyone he reasonably suspects is committing an offence under this section..

The Electoral Law Act (Northern Ireland) 1962 (c. 14 (N.I.))

2.  In paragraph 13(1) of Schedule 9 for the words “Article 10(1) of the Public Order (Northern Ireland) Order 1981” substitute the words “Article 7(2) of the Public Order (Northern Ireland) Order 1987”.

3.  In section 9(1) for the words from the beginning to “liquor is sold” substitute the words—

Any person—

(a)guilty of any indecent behaviour in any street, road, highway or other public place, or in any place to which the public have access (whether as of right or by permission and whether subject to or free of charge); or

(b)guilty of any riotous, disorderly or indecent behaviour, or of any behaviour whereby a breach of the peace is likely to be occasioned, on any premises where intoxicating liquor is sold,.

4.  In paragraph 15(2) of Schedule 1 for the words from “in connection with” to the end substitute the words “in accordance with the provisions of Article 5(2) of the Public Order (Northern Ireland) Order 1987.”.

5.  At the end of section 28 add the following subsection—

(6) In this section “words” includes pictures, visual images, gestures and other methods of signifying meaning..

6.  In section 42(3) for the words “section 43 and paragraph 6 of Schedule 2” substitute the words “and section 43”.
