Where a condition to which the pleasure permit is subject is contravened or a requirement imposed under Article 164 is contravened the holder of the pleasure permit shall be guilty of an offence.

In any proceedings for an offence under paragraph (1) it shall be a defence for the holder of the pleasure permit to prove that the contravention occurred without his consent or connivance and that he exercised due diligence to prevent it.
