7.—(1) A person who is guilty of an offence under Article 4(2) or 5(3) shall be liable on summary convictionF1... to a fine not exceeding[F1 level 4 on the standard scale]F1,F1... and if the contravention of the provision of regulations under Article 4, or, as the case may be, the failure to do or refrain from doing anything in accordance with the notice under Article 5, in respect of which he is convicted is continued after the conviction he shall be guilty of a further offence under Article 4(2) or, as the case may be, Article 5(3) and may be punished accordingly.
(2) A person who is guilty of an offence under Article 6(3) shall be liable on summary convicion to a fine not exceeding[F1 level 3 on the standard scale]F1.
(3) A prosecution for an offence under this Order shall not be instituted except by or with the consent of the Department.
