I183Revocation of Tribunal's appointment where P regains capacity

This section applies if—

a

an appointment of a nominated person for a person (“P”) has been made by the Tribunal under section 81; and

b

P regains capacity to make decisions about who should be his or her nominated person.

P may, at any time while he or she has capacity to do so, apply to the Tribunal for revocation of the appointment.

On an application under this section the Tribunal must make an order revoking the appointment under section 81 unless it is satisfied that P no longer has capacity to make decisions about who should be his or her nominated person.

If on such an application the Tribunal is satisfied—

a

that P no longer has capacity to make decisions about who should be his or her nominated person, but

b

that a different person should be appointed as P's nominated person,

the Tribunal may make an order under section 81.
