Sections 169 and 170: Certificate of lawfulness of existing use or development and Certificate of lawfulness of proposed use or development
Section 169 enables a person to apply to a council for a certificate to establish whether any existing use or development, or non compliance with a condition of a planning approval, is lawful. Section 170 enables any person to apply to a council to establish whether any proposed use or development, or any operations to be carried out in, on, over or under land is lawful.
