I19Legal assistance

The Commissioner may provide an individual with assistance if the person is, or may become, a party to actual or possible legal proceedings in England and Wales that are relevant to a matter in respect of which the Commissioner has a function.

This section does not affect any restriction imposed in respect of representation—

a

by virtue of an enactment, or

b

in accordance with the practice of a court or tribunal.

It is for the Commissioner to determine, for the purposes of this section, whether there are possible legal proceedings that are relevant to a matter in respect of which the Commissioner has a function.

In this section—

  • assistance” (“cymorth”) includes, but is not limited to, the following things—

    1. a

      legal advice;

    2. b

      legal representation;

    3. c

      facilities for the settlement of a dispute;

  • legal proceedings” (“achos cyfreithiol”) includes, but is not limited to, proceedings before any court or tribunal.
