9.—(1) Notwithstanding the repeal on 1st April 1994 of paragraph 4 of Schedule 1 to the Education Act 1981, under which regulation 12 of the Education (Special Educational Needs) Regulations 1983(1) was made, that regulation shall, subject to sub-paragraph (2) below, continue in force on and after that date.
(2) Regulation 12 of the Education (Special Educational Needs) Regulations 1983, as so continued in force, shall have effect as if made under section paragraph 7(2) of Schedule 10 to the Act and may be amended or revoked thereunder.
