6 Penalties.E+W+S

(1)Any person guilty of an offence under any provision of this Act shall be liable on summary conviction to a fine not exceeding [F1level 5 on the standard scale].

(2)Where a person is convicted of any offence under this Act or of any offence under the [F2Protection of Animals Acts 1911 to 1964,] [F2 Protection of Animals Act 1911,] the Protection of Animals (Scotland) Acts 1912 to 1964, [F3 the Performing Animals (Regulation) Act 1925,] the Pet Animals Act 1951, [F4 the Animals (Cruel Poisons) Act 1962,] the M1Animal Boarding Establishments Act 1963, the M2M3Riding Establishments Acts 1964 and 1970, [F5or the M4Breeding of Dogs Act 1973,] [F6 or of an offence under any of sections 4, 5, 6(1) and (2), 7 to 9 and 11 of the Animal Welfare Act 2006,] the court by which he is convicted may cancel any licence held by him under this Act, and may, whether or not he is the holder of such a licence, disqualify him from keeping any dangerous wild animal for such period as the court thinks fit.

(3)A court which has ordered the cancellation of a person’s licence, or his disqualification, in pursuance of the last foregoing subsection may, if it thinks fit, suspend the operation of the order pending an appeal.

[F7(3A) Where a person is convicted of any offence under sections 28C or 28F(16) of the Animal Health Act 1981 (c. 22), F8... sections 19 to 24, 25(7), 29 or 40(11) of the Animal Health and Welfare (Scotland) Act 2006 (asp 11) [F9or regulation 23 of the Animal Welfare (Licensing of Activities Involving Animals) (Scotland) Regulations 2021], subsections (2) and (3) apply as they do to convictions under this Act.]

[F10(3B)Where a person is convicted of an offence under section 13(6) of the Animal Welfare Act 2006 arising from the contravention of section 13(1) of that Act in relation to dog breeding in Wales, or of an offence under the Animal Welfare (Breeding of Dogs) (Wales) Regulations 2014, subsections (2) and (3) apply as they do to convictions under this Act.]

[F11(3C)Where a person is convicted of an offence under section 13(6) of the Animal Welfare Act 2006 arising from the contravention of section 13(1) of that Act in relation to the carrying on of an activity in England, or of an offence under the Animal Welfare (Licensing of Activities Involving Animals) (England) Regulations 2018, subsections (2) and (3) apply as they do to convictions under this Act.]
