THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Directive 75/442/EEC of 15 July 1975 on waste(1), as last amended by Directive 91/692/EEC(2), and in particular Article 18 thereof,

Having regard to Council Directive 91/157/EEC of 18 March 1991 on batteries and accumulators containing certain dangerous substances(3) and in particular Article 10 thereof,

Whereas detailed arrangements should be established for the making system provided for in Article 4 of Directive 91/157/EEC;

Whereas appliances need not be marked, since Annex II to Directive 91/157/EEC provides for a special information system for appliances from which the consumer cannot easily remove the battery or accumulator;

Whereas there is a need for a symbol clearly showing that batteries or accumulators covered by Directive 91/157/EEC should be collected separately from other household waste;

Whereas the use of this symbol for batteries and accumulators covered by Directive 91/157/EEC must be protected;

Whereas the measures provided for in this Directive are in accordance with the opinion delivered by the Committee for the Adaptation to Scientific and Technical Progress of Community Legislation on Waste,

HAS ADOPTED THIS DIRECTIVE:
