The National Assembly for Wales, in exercise of the powers conferred upon the Secretary of State by sections 75 and 104(1) of the New Roads and Street Works Act 1991(1) and which are now exercisable by it in relation to Wales(2), hereby makes the following Regulations:

Citation, commencement and application

1.—(1) These Regulations may be cited as the Street Works (Inspection Fees) (Amendment) (Wales) Regulations 2001 and they come into force on the 1 August 2001.

(2) These Regulations apply to Wales.

Increase in the inspection fee

2.  In regulation 3(1) of the Street Works (Inspection Fees) Regulations 1992(3) there shall be substituted for the figure of “£14.50” there the figure of “£15.50”.

Revocation

3.  The Street Works (Inspection Fees) (Amendment) Regulations 1998(4) are revoked so far as they apply to Wales.

Explanatory Note

(This note is not part of the Regulations)

These Regulations provide for an increase from £14.50 to £15.50 in the fee payable by undertakers for inspections of their work by street authorities in Wales under regulation 3(1) of the Street Works (Inspection Fees) Regulations 1992 (S.I. 1992/1688). The Street Works (Inspection Fees) (Amendment) Regulations 1998 (S.I. 1998/978) (which provided for an earlier increase in the fee) are revoked so far as they apply to Wales.

The powers of the Secretary of State, so far as exercisable in relation to Wales, were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672).
