The Education (Information About Children in Alternative Provision) (England) (Amendment) Regulations 2017

The Secretary of State for Education makes the following Regulations, in exercise of the powers conferred by sections 537A and 537B of the Education Act 1996(1):

Citation and commencement

1.  These Regulations may be cited as the Education (Information About Children in Alternative Provision) (England) (Amendment) Regulations 2017 and come into force on 1st September 2017.

Amendment of the Education (Information About Children in Alternative Provision) (England) Regulations 2007

2.  After regulation 6(k) of the Education (Information About Children in Alternative Provision)(England) Regulations 2007(2) insert—

(l)individual special educational needs;

(m)primary reason for funded provision placement;

(n)date of entry into funded provision;

(o)date of leaving funded provision;

(p)frequency of attendance..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Education (Information About Children in Alternative Provision) (England) Regulations 2007 to prescribe for the supply of additional individual data items about children receiving education which is funded by the local authority outside mainstream schools, usually referred to as alternative provision.

Regulation 2 stipulates the additional items of individual information to be supplied by persons providing alternative provision.

The Secretary of State’s published guidance online at https://www.gov.uk/guidance/alternative-provision-census regarding the collection of information from pupils in alternative provision will be amended to provide for these additional data items.

An impact assessment has not been produced for this instrument as it has no impact on businesses and civil society organisations. The instrument has a minimal impact on the public sector.
