The Leader of the House of Commons, in exercise of the powers conferred on him by section 2(1), (2) and (4) of the Parliamentary and other Pensions Act 1987(1), with the consent of the Minister for the Civil Service (2), and after consultation with the Trustees of the Parliamentary Contributory Pension Fund and such persons as appeared to him to represent persons likely to be affected by the Regulations, makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Parliamentary Pensions (Amendment) (No.2) Regulations 2006.

(2) These Regulations come into force on 18th August 2006.

(3) Regulation 2 has effect from 5th July 2006.

(4) In these Regulations “the Contributory Fund Regulations” means the Parliamentary Pensions (Consolidation and Amendment) Regulations 1993(3).

Amendment of the Contributory Fund Regulations

2.—(1) Paragraph (3) of regulation C3 of the Contributory Fund Regulations (membership for office holders) is amended as follows.

(2) In sub-paragraph (b) omit “and”.

(3) After paragraph (b) insert “(ba) the office of Speaker of the House of Lords; and”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Parliamentary Pensions (Consolidation and Amendment) Regulations 1993 (S.I. 1993/3253), which were made under the Parliamentary and other Pensions Act 1987 (c. 45) (“the 1987 Act”) and set out a pension scheme (“the Scheme”) applying to Members of Parliament and holders of certain offices. The 1987 Act was amended by SI 2006/1640 so that, with effect from 5th July 2006, regulations made under the 1987 Act can apply to the Speaker of the House of Lords.

The amendments made by these Regulations allow the holder of the office of Speaker of the House of Lords to participate in the Scheme with effect from 5th July 2006. Section 2(4)(b)(i) of the 1987 Act authorises the making of provisions taking effect from a date earlier than the date the Regulations are made.
