The Secretary of State for Environment, Food and Rural Affairs, in exercise of the powers conferred upon the appropriate Minister by section 11(1)(c) of the Channel Tunnel Act 1987(1) makes the following Order:

1.  This Order may be cited as the Channel Tunnel (International Arrangements) (Amendment) Order 2003 and comes into force on 30th November 2003.

Amendment to the Channel Tunnel (International Arrangements) Order 1993U.K.

2.—(1) Part II of Schedule 3 of the Channel Tunnel (International Arrangements) Order 1993(2) shall be amended in accordance with this article.

(2) For paragraph 3(a) there shall be substituted the following—

(a)construct and maintain fencing around the entrance to each tunnel, except at places where gaps are necessary to allow the passage of vehicles through the tunnel, of such material and of such a height above and depth below the surface of the ground as to ensure, so far as is practicable, that an animal cannot cross it, and.

(3) Paragraph 4 shall be deleted.

(4) In paragraph 5(g) for the words “described in paragraph 4(b)” there shall be substituted the words “described in paragraph 3(a)”.

(5) In paragraph 6(a) for the words “any installation described in paragraph 4” there shall be substituted the words “the fencing described in paragraph 3(a)”.

Explanatory Note

(This note is not part of the Order)

This Order amends the Channel Tunnel (International Arrangements) Order 1993. It removes the requirement in that Order that Concessionaires maintain electrified grids at the entrance to each tunnel intended to deter animals from entering the tunnels.

No Regulatory Impact Assessment has been prepared in respect of this Order.
