The Education (School Teachers' Pay and Conditions) Order 1992

The review body appointed under section 1(1) of the School Teachers' Pay and Conditions Act 1991(1) having made a report following the reference to them of certain matters, the Secretary of State for Education and Science, in exercise of the powers conferred by section 2(1), (3), and (4) and 5(4) of the Act and after consulting such associations of local education authorities, such bodies representing the interests of governors of voluntary and grant-maintained schools and such bodies representing school teachers as appeared to him to be concerned, hereby makes the following Order—

Citation and commencement

1.  This Order may be cited as the Education (School Teachers' Pay and Conditions) Order 1992 and shall come into force on 1st April 1992.

Application and effect

2.  This Order applies to all school teachers (as defined in the School Teachers' Pay and Conditions Act 1991) in England and Wales and gives effect without any material modification to recommendations of the review body.

School Teachers' Pay and Conditions

3.  It is hereby directed that the provisions set out in the document published by Her Majesty’s Stationery Office and entitled “The School Teachers' Pay and Conditions Document 1992” shall have effect—

(a)as regards the rates of London Area allowances set out in paragraph 18(1) of the said Document, from 1st July 1991;

(b)as regards all other provisions, from 1st April 1992.

Explanatory Note

(This note is not part of the Order)

This Order, which is the first Order made under section 2(1) of the School Teachers' Pay and Conditions Act 1991, refers to a document entitled “School Teachers' Pay and Conditions Document 1992” published by Her Majesty’s Stationery Office, which is obtainable from Government book shops and through booksellers. The Order directs that the provisions set out in the Document shall have effect, as regards the rates of London Area allowances set out in paragraph 18(1), from 1st July 1991; and, as regards all other provisions, from 1st April 1992.

The Order applies to all school teachers (as defined in section 5(1) of the Act) in England and Wales. By virtue of section 2(6)(a) of that Act, the remuneration of school teachers to whom the Order applies is to be determined, and paid to them by local education authorities or, in the case of school teachers in grant-maintained schools, by the governing bodies of such schools, in accordance with the scales and other provisions set out in the Document; by virtue of section 2(6)(b), the provisions set out in the Document relating to other statutory conditions of employment have effect as terms of the contracts of employment of school teachers to whom the Order applies.

In accordance with section 2(9)(a) of the Act, the Order contains a statement that it gives effect without any material modification to recommendations of the review body appointed by the Prime Minister under section 1 of the Act.

The retrospective effect of the Order as regards London Area allowances is authorised by section 2(4)(f) of the Act.

By virtue of article 4 of the School Teachers' Pay and Conditions Act 1991 (Commencement No. 2 and Transitional Provision) Order 1992, on the coming into force of this Order, the School Teachers' Pay and Conditions Document 1991, which has effect by virtue of the Education (School Teachers' Pay and Conditions) Order 1991, ceases to have effect.
