The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in the exercise of the powers conferred on them by sections 4, 5(1), 7, 8, 11(2),(7), 17(2), 21(2),(3), 24(4), 25, 26A, 28(1), 30, 39(2) and 40(1) of the Planning (Hazardous Substances) Act 1990(1), and of all other powers enabling them in that behalf, hereby make the following Regulations:

1990, c. 10; relevant amendments are made by paragraphs 2, 3 and 4 of Schedule 13, and Part VII of Schedule 16, to the Environmental Protection Act 1990 (c. 43) and by paragraphs 13 and 30 of Schedule 3 to the Planning and Compensation Act 1991 (c. 34). Section 26A was inserted by paragraph 9 of Schedule 13 to the Environmental Protection Act 1990. See section 39(2) and section 336(1) of the Town and Country Planning Act 1990 (c. 8) for the definition of “prescribed”.
