The Coast Protection (Variation of Excluded Waters) Regulations, 1958

The Minister of Housing and Local Government, in exercise of his powers under paragraph 113 of the Fourth Schedule to the Coast Protection Act, 1949, and of all other powers enabling him in that behalf, hereby makes the following regulations:—

1.—(1) These regulations may be cited as the Coast Protection (Variation of Excluded Waters) Regulations, 1958, and shall come into operation on the 23rd day of December, 1958.

(2) The Interpretation Act, 1889, applies to the interpretation of these regulations as it applies to the interpretation of an Act of Parliament.

2.  The Fourth Schedule to the Coast Protection Act, 1949, shall be varied as follows:—

(1) After paragraph 17 there shall be inserted the following paragraph—

17a.  The Brightlingsea Creek, above a line drawn between St. Osyth Point and the shoreward end of the ferry landing stage.

(2) For paragraph 18 there shall be substituted the following paragraph—

18.  The River Colne, above a line drawn between Viaduct Sluice, to the west of Bateman's Tower, and Mersea Stone.

(3) For paragraph 45 there shall be substituted the following paragraph—

45.  The River Exe, above latitude 50° 30&min; 50&sec; North..

EXPLANATORY NOTE

The Fourth Schedule to the Coast Protection Act, 1949, excludes certain waters for the purposes of definitions of “Sea” and “Seashore” in the Act, but provides that the Schedule may be varied either by adding waters to it or by removing waters from it . These Regulations vary the Schedule by removing certain waters from it.
