In pursuance of the powers conferred upon me by the Metropolitan Public Carriage Act, 1869, and the London Cab and Stage Carriage Act, 1907 I hereby order as follows:—

1.—(1) For the definition of “Commissioner of Police” in sub-paragraph (1) of paragraph 2 of the London Cab Order, 1934 (1), there shall be substituted the following definition:—

the Assistant Commissioner” means the person, being an Assistant Commissioner of Police of the Metropolis, for the time being appointed by the Secretary of State under section eleven of the Metropolitan Public Carriage Act, 1869, to grant licences under sections six and eight of that Act;;

and for the words “Commissioner of Police” and “Commissioner of Police of the Metropolis”, where they otherwise occur in the said Order, there shall be substituted respectively the words “Assistant Commissioner” and “Assistant Commissioner of Police of the Metropolis”.

(2) Paragraph 3 of the said Order (which directs that the Commissioner of Police of the Metropolis may grant licences under sections six and eight of the Metropolitan Public Carriage Act, 1869) shall be omitted.

2.  Any licence granted or other thing done by or in relation to the Commissioner of Police of the Metropolis before the first day of January, 1956, under or in accordance with the London Cab Order, 1934, shall, if in force or effective immediately before the said date, have effect as if granted or done, under or in accordance with the said Order as amended by this Order, by or in relation to the Assistant Commissioner referred to in the said Order.

3.  This Order may be cited as the London Cab Order, 1955, and shall come into operation on the first day of January, 1956.

EXPLANATORY NOTE

This Order makes provision necessary to enable the Secretary of State, in pursuance of his power under section 11 of the Metropolitan Public Carriage Act, 1869, to appoint an Assistant Commissioner of Police of the Metropolis to grant cab licences and cab-drivers' licences. Article 1(1) of the Order substitutes in the London Cab Order, 1934, a reference to an Assistant Commissioner so appointed for the existing references to the Commissioner of Police of the Metropolis, and Article 1(2) revokes paragraph 3 of the 1934 Order whereby the Secretary of State had directed under section 11 of the 1869 Act that the Commissioner of Police should be the licensing authority.
