[F1Without prejudice to section 13 of the Prisons (Scotland) Act 1989 (c. 45)(legal custody of prisoners),] any person required or authorised by or under this Act or any other enactment to be taken to any place, or to be detained or kept in custody [F2is], while being so taken or detained or kept, F3. . . in legal custody.
