The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 1(1) and (2)(e) of, and paragraph 5(b) of Schedule 2 to, the Public Service Pensions Act 2013(1) and all other powers enabling them to do so.

In accordance with section 22(2)(a) of that Act, the Scottish Ministers consulted the representatives of such persons as appeared to them likely to be affected by these Regulations.

In accordance with section 22(2)(b) of that Act, the Scottish Ministers laid before the Scottish Parliament a report concerning the changes to the members’ contribution rates under the National Health Service Pension Scheme (Scotland) made by these Regulations.

In accordance with section 3(5) of that Act, these Regulations are made with the consent of the Treasury.

Citation, commencement and effect

1.—(1) These Regulations may be cited as the National Health Service Pension Scheme (Scotland) Amendment Regulations 2016.

(2) These Regulations come into force on 1st April 2016 and have effect from 1st April 2015.

Amendment of the National Health Service Pension Scheme (Scotland) Regulations 2015

2.  The National Health Service Pension Scheme (Scotland) Regulations 2015(2) are amended as follows.

Regulation 27

3.  In regulation 27 (pensionable earnings)—

(a)in paragraph (1), for the Table substitute—

Regulation 30

4.  In regulation 30 (members’ contributions: employees)—

(a)in paragraph (3)—

(i)for the words from “M’s contribution rate” to “earnings fall.”, substitute—

M’s contribution rate—

for the scheme year 2015/16 is the percentage specified in column 2 of Table 1 below in respect of the corresponding pensionable earnings band specified in column 1 into which M’s pensionable earnings fall; and

(b)

for the scheme year 2016/17 is the percentage specified in column 2 of Table 2 below in respect of the corresponding pensionable earnings band specified in column 1 into which M’s pensionable earnings fall.;

(ii)for “Table: Scheme Year 2015/16”, substitute “Table 1”; and

(iii)at the end, insert—

Regulation 31

5.  In regulation 31 (members’ contributions: practitioners and non-GP providers)—

(a)for paragraph (3), substitute—

(3) M’s contribution rate—

(a)for the scheme year 2015/16 is the percentage specified in column 2 of Table 1 in paragraph (9) in respect of the corresponding pensionable earnings band specified in column 1 into which M’s pensionable earnings fall; and

(b)for the scheme year 2016/17 is the percentage specified in column 2 of Table 2 in paragraph (9) in respect of the corresponding pensionable earnings band specified in column 1 into which M’s pensionable earnings fall.;

(b)in paragraph (4), omit “specified in the Table”;

(c)in paragraph (5), for “medical practitioner” substitute “provider”;

(d)in paragraph (9)—

(i)for “The Table”, substitute “The Tables are”;

(ii)for “Table: Scheme Year 2015/16”, substitute “Table 1”;

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the National Health Service Pension Scheme (Scotland) Regulations 2015. Regulations 4, 5 and 15 include provision inserting new employee contributions tables which reflect the NHS pay uplift from 1st April 2015 and making consequential changes. Otherwise, these Regulations are concerned with correcting errors in, and otherwise clarifying, the 2015 Regulations.

Section 26 was amended by the Health and Social Security Act 1984 (c.48), Schedule 1, Part II, paragraph 1, the Health and Medicines Act 1988 (c.49), section 13(4) and the Smoking, Health and Social Care (Scotland) Act 2005 (asp 13), sections 13(2) and 19.
