The M74 Motorway (Fullarton Road to the M8 West of Kingston Bridge) (Speed Limit) Regulations 2012

The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 17(2), (3) and (3ZA) of the Road Traffic Regulation Act 1984(1) and all other powers enabling them to do so.

In accordance with section 17(3A)(2) of that Act they have consulted with such representative organisations as they think fit.

Citation and commencement

1.  These Regulations may be cited as the M74 Motorway (Fullarton Road to the M8 West of Kingston Bridge) (Speed Limit) Regulations 2012 and come into force on 28th December 2012.

Interpretation

2.  In these Regulations—

“the M8” means the M8/A8 Edinburgh - Greenock Trunk Road;

“the M74” means the M74/A74(M)/A74 Glasgow - Carlisle Trunk Road;

“point 1” means a point 32 metres or thereby east of the point of intersection of the centre lines of the M74 and Carmyle Avenue;

“point 2” means a point 710 metres or thereby southeast of the point of intersection of the centre lines of the M74 and Polmadie Road;

“point 3” means a point 60 metres or thereby northeast of the point of intersection of the centre lines of Scotland Street and West Street,

and references to “the Schedule” are to the Schedule to these Regulations.

Speed limits

3.  No person may drive a motor vehicle at a speed exceeding—

(a)60 miles per hour on those lengths of road described in Part 1 of the Schedule;

(b)50 miles per hour on those lengths of road described in Part 2 of the Schedule;

(c)30 miles per hour on those lengths of road described in Part 3 of the Schedule.

Exemptions

4.  No speed limit imposed by these Regulations applies to vehicles falling within regulation 3(4) of the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011(3) when used in accordance with regulation 3(5) of those Regulations.

Regulation 3

SCHEDULE

PART 160 MPH SPEED LIMIT

1.  That length of the carriageway of the M74 between point 1 and point 2, a distance of 4.9 kilometres or thereby.

2.  That length of the M74 being part of the eastbound on-slip road from Fullarton Road, from a point 26 metres or thereby east of the east kerb line of the Fullarton Road roundabout (as measured along the northernmost kerb line of the on-slip road), eastwards to its junction with the main eastbound carriageway of the M74, a distance of 507 metres or thereby.

3.  That length of the M74 being part of the westbound on-slip road from Fullarton Road, from a point 34 metres or thereby west of the west kerb line of the Fullarton Road roundabout (as measured along the southernmost kerb line of the on-slip road), westwards to its junction with the main westbound carriageway of the M74, a distance of 537 metres or thereby.

4.  That length of the M74 being part of the eastbound off-slip road to Fullarton Road, from its junction with the main eastbound carriageway of the M74, eastwards to a point 239 metres or thereby from that junction (as measured along the northernmost kerb line of the off-slip road).

5.  That length of the M74 being part of the westbound off-slip road to Fullarton Road, from its junction with the main westbound carriageway of the M74, westwards to a point 237 metres or thereby from that junction (as measured along the southernmost kerb line of the off-slip road).

6.  That length of the M74 being part of the eastbound on-slip road from Cambuslang Road, from a point 93 metres or thereby east of the north east kerb line of Cambuslang Road (as measured along the northernmost kerb line of the on-slip road), eastwards to its junction with the main eastbound carriageway of the M74, a distance of 572 metres or thereby.

7.  That length of the M74 being part of the westbound on-slip road from Cambuslang Road, from a point 103 metres or thereby west of the south west kerb line of Cambuslang Road (as measured along the southernmost kerb line of the on-slip road), westwards to its junction with the main westbound carriageway of the M74, a distance of 600 metres or thereby.

8.  That length of the M74 being part of the eastbound off-slip road to Cambuslang Road, from its junction with the main eastbound carriageway of the M74, eastwards to a point 270 metres or thereby from that junction (as measured along the northernmost kerb line of the off-slip road).

9.  That length of the M74 being part of the westbound off-slip road to Cambuslang Road, from its junction with the main westbound carriageway of the M74, westwards to a point 247 metres or thereby from that junction (as measured along the southernmost kerb line of the off-slip road).

PART 250 MPH SPEED LIMIT

1.  That length of the carriageway of the M74 between point 2 and point 3, a distance of 2.80 kilometres or thereby.

2.  That length of the eastbound carriageway of the M74 from a point 70 metres or thereby east of the intersection of the centre line of the outer eastbound carriageway of the M8 and the centre line of Seaward Street, to point 3, a distance of 755 metres or thereby.

3.  That length of the westbound carriageway of the M74, from point 3 to a point 145 metres or thereby east of the intersection of the centre line of the outer westbound carriageway of the M8 and the centre line of Seaward Street, a distance of 660 metres or thereby.

4.  That length of the M74 being part of the eastbound on-slip road from Polmadie Road, from a point 27 metres or thereby east of the east kerb line of Polmadie Road (as measured along the northernmost kerb line of the on-slip road), eastwards to its junction with the main eastbound carriageway of the M74, a distance of 588 metres or thereby.

5.  That length of the M74 being part of the westbound on-slip road from Polmadie Road, from a point 40 metres or thereby north of the west kerb line of Polmadie Road (as measured along the southernmost kerb line of the on-slip road), westwards to its junction with the main westbound carriageway of the M74, a distance of 510 metres or thereby.

6.  That length of the M74 being part of the eastbound off-slip road to Polmadie Road, from its junction with the main eastbound carriageway of the M74, eastwards to a point 245 metres or thereby from that junction (as measured along the northernmost kerb line of the off-slip road).

7.  That length of road the M74 being part of the westbound off-slip road to Polmadie Road, from its junction with the main westbound carriageway of the M74, westwards to a point 263 metres or thereby from that junction (as measured along the southernmost kerb line of the off-slip road).

8.  That length of the M74 being part of the eastbound on-slip road from Dalintober Street, from a point 166 metres or thereby south of the intersection of the centre lines of Dalintober Street and Wallace Street, eastwards to its junction with the main eastbound carriageway of the M74, a distance of 399 metres or thereby.

9.  That length of the M74 being part of the eastbound off-slip road to Paisley Road, from its junction with the eastbound carriageway of the M74, north eastwards to a point 127 metres or thereby from that junction (as measured along the northernmost kerb line of the off-slip road).

10.  That length of the M74 being part of the westbound off-slip road to Carnoustie Street, from its junction with the main westbound carriageway of the M74, westwards to a point 111 metres or thereby from that junction (as measured along the northernmost kerb line of the off-slip road).

PART 330 MPH SPEED LIMIT

1.  That length of the M74 being part of the eastbound on-slip road from Fullarton Road, from the east kerb line of the Fullarton Road roundabout, eastwards to a point 26 metres or thereby east of that kerb line (as measured along the northernmost kerb line of the on-slip road).

2.  That length of the M74 being part of the westbound on-slip road from Fullarton Road, from the west kerb line of the Fullarton Road roundabout, westwards to a point 34 metres or thereby west of that kerb line (as measured along the southernmost kerb line of the on-slip road).

3.  That length of M74 being part of the eastbound off-slip road to Fullarton Road, from a point 239 metres or thereby from its junction with the main eastbound carriageway of the M74 (as measured along the northernmost kerb line of the off-slip road), eastwards to the west kerb line of the Fullarton Road roundabout, a distance of 313 metres or thereby.

4.  That length of the M74 being part of the westbound off-slip road to Fullarton Road, from a point 237 metres or thereby from its junction with the main westbound carriageway of the M74 (as measured along the southernmost kerb line of the off-slip road), westwards to the east kerb line of the Fullarton Road roundabout, a distance of 372 metres or thereby.

5.  That length of the M74 being part of the eastbound on-slip road from Cambuslang Road, from the north east kerb line of Cambuslang Road eastwards to a point 93 metres or thereby east of that kerb line (as measured along the northernmost kerb line of the on-slip road).

6.  That length of the M74 being part of the westbound on-slip road from Cambuslang Road, from the south west kerb line of Cambuslang Road, westwards to a point 103 metres or thereby west of that kerb line (as measured along the southernmost kerb line of the on-slip road).

7.  That length of the M74 being part of the eastbound off-slip road to Cambuslang Road, from a point 270 metres or thereby from its junction with the main eastbound carriageway of the M74 (as measured along the northernmost kerb line of the off-slip road), eastwards to the west kerb line of Cambuslang Road, a distance of 271 metres or thereby.

8.  That length of the M74 being part of the westbound off-slip road to Cambuslang Road, from a point 247 metres or thereby from its junction with the main westbound carriageway of the M74 (as measured along the southernmost kerb line of the off-slip road), westwards to the north east kerb line of Cambuslang Road, a distance of 460 metres or thereby.

9.  That length of the M74 being part of the eastbound on-slip road from Polmadie Road, from the east kerb line of Polmadie Road to a point 27 metres or thereby east of that kerb line (as measured along the northernmost kerb line of the on-slip road).

10.  That length of the M74 being part of the westbound on-slip road from Polmadie Road, from the west kerb line of Polmadie Road to a point 40 metres or thereby north of that kerb line (as measured along the southernmost kerb line of the on-slip road).

11.  That length of the M74 being part of the eastbound off-slip road to Polmadie Road, from a point 245 metres or thereby from its junction with the main eastbound carriageway of the M74 (as measured along the northernmost kerb line of the off-slip road), eastwards to the west kerb line of Polmadie Road, a distance of 283 metres or thereby.

12.  That length of the M74 being part of the westbound off-slip road to Polmadie Road, from a point 263 metres or thereby from its junction with the main westbound carriageway of the M74 (as measured along the southernmost kerb line of the off-slip road), westwards to the east kerb line of Polmadie Road, a distance of 236 metres or thereby.

13.  That length of the M74 being part of the eastbound on-slip road from Dalintober Street, from a point 65 metres or thereby south of the intersection of the centre lines of Dalintober Street and Wallace Street to a point 166 metres or thereby southeast of that intersection, a distance of 101 metres or thereby.

14.  That length of the M74 being the eastbound off-slip road to Paisley Road, from a point 127 metres or thereby from its junction with the eastbound carriageway of the M74 (as measured along the northernmost kerb line of the on-slip road), north eastwards to the south kerb line of Paisley Road, a distance of 349 metres or thereby.

15.  That length of the M74 being the westbound off-slip road to Carnoustie Street, from a point 111 metres or thereby from the junction of the main westbound carriageway of the M74 (as measured along the northernmost kerb line of the on-slip road), westwards to the east kerb line of Carnoustie Street, a distance of 232 metres or thereby.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations apply permanent speed limits to the M74 motorway between Fullarton Road, Glasgow and its connection to the M8 motorway west of the Kingston Bridge. Speed limits are applied to the main carriageway and slip roads.

Regulation 3 and Part 1 of the Schedule set the maximum speed limit for the driving of motor vehicles at 60 miles per hour on certain lengths of road.

Regulation 3 and Part 2 of the Schedule set the maximum speed limit for the driving of motor vehicles at 50 miles per hour on certain lengths of road.

Regulation 3 and Part 3 of the Schedule set the maximum speed limit for the driving of motor vehicles at 30 miles per hour on certain lengths of road.

Regulation 4 provides that the speed limits do not apply to vehicles used for naval, military or air force purposes while being driven in response, or for practice in responding, to a national security emergency by a member of the special forces who has been trained in driving at high speeds or for the purpose of such training.

The Regulations come into force on 28th December 2012. Prior to that date, temporary speed limits applied to the roads covered by these Regulations, by virtue of the M74 Motorway (Fullarton Road to the M8 Motorway West of Kingston Bridge) (Temporary Speed Restriction) Order 2011 (S.S.I. 2011/275).
